طبيعي است كه وقتي كه كارها

فصل اول-تعاريف
ماده 1- وزارتخانه: واحد سازماني مشخصي است كه تحقق يك يا چند هدف از اهداف دولت را بر عهده دارد و به موجب قانون ايجاد شده يا مي شود و توسط وزير اداره مي گردد.
ماده2- مؤسسه دولتي: واحد سازماني مشخصي است كه به موجب قانون ايجادشده يا مي شود و با داشتن استقلال حقوقي، بخشي از وظايف و اموري را كه بر عهده يكي از قواي سه گانه و ساير مراجع قانوني مي باشد انجام مي دهد.
كليه سازمان هايي كه در قانون اساسي نام برده شده است در حكم مؤسسه دولتي شناخته ميشود.
ماده3- مؤسسه يا نهاد عمومي غيردولتي: واحد سازماني مشخصي است كه داراي استقلال حقوقي است و با تصويب مجلس شوراي اسلامي ايجاد شده يا مي شود و بيش از پنجاه درصد بودجه سالانه آن از محل منابع غيردولتي تأمين گردد و عهده دار وظايف و خدماتي است كه جنبه عمومي دارد.
ماده4- شركت دولتي: بنگاه اقتصادي است كه به موجب قانون براي انجام قسمتي از تصديهاي دولت به موجب سياست هاي كلي اصل چهل و چهارم قانون اساسي، ابلاغي از سوي مقام معظم رهبري جزو وظايف دولت محسوب مي گردد ايجاد و بيش از پنجاه درصد سرمايه و سهام آن متعلق به دولت مي باشد. هر شركت تجاري كه از طريق سرمايه گذاري وزارتخانه ها، مؤسسات دولتي و شركتهاي دولتي منفردا يا مشتركا ايجاد شده مادام كه بيش از پنجاه درصد سهام آن منفردا يا مشتركا متعلق به واحدهاي سازماني فوق الذكر باشد شركت دولتي است.
